Cooks Source Magazine Assignment

Read this  Cooks Source article and answer the following questions in your blog post:


  1. In your own words, summarize what the article is about
  2. Did Cook's Magazine have the legal right to post Monica Gaudio's work? Why or why not?
  3. Did Cook's Magazine behave morally?
  4. What is the difference between what is legal and what is moral?
  5. Can you give an example of when the law and morals values are at odds?

  1. 1. This article discusses whether it is legal or illegal to use someone else's information without their consent. It describes a recipe that Monica Gaudio wrote that was posted without her permission and the legal and moral issues that surfaced as a result. Interesting topic to explore in terms of copyright infringement laws.

    2. Can someone legally use information without citing the source is an interesting question? We teach students that they must give the owner of intellectual property credit, not take it as their own property and violate copyright. According to the article, Cook may have the legal right to post Monica's work as public domain, but morally Cook was wrong to use the information that Monica posted. It seems as if Monica should be compensated for her recipe.

    3. From my perspective, it is not moral to use information without getting consent from the owner because your are claiming someone else's intellectual property as your own. This property is not your work or original thinking, so credit must be given to the originator.

    4. Certainly there is a fine line between morality (one's values and beliefs) and legality (legal standards that are enforceable). If it is legal, then this standard must be followed by all members of society and a lack thereof could result in swift consequences. This standard is not debatable even if one believes their civil liberties are being violated. An example of someone acting morally, but not legally is when a person disobeys a law in the form of civil disobedience because they perceive a violation of their civil rights.

    A person example is I have been scammed on websites by purchasing a trial size herbal supplement or face cream only to be mailed costly full sized products to my home on a monthly basis. To be that was a lack of disclosure however upon inquiry, the company claimed a legal disclaimer which you can barely see the fine print on the site. Legal yes, Moral no! Buyer beware is the rule of thumb here. Luckily, laws change as society evolves and sometimes this reflects a higher moral ground.

    5. Beliefs are individual, but the law is the standard. This legal standard is upheld to the highest court in the land. Interesting topic to explore as we start the course!
